Joker Backgammon Terms and Conditions

Welcome to Joker Backgammon! These Terms and Conditions of Use ("Terms") are a legal agreement between you and Joker Backgammon ("Joker Backgammon," "we," "us," or "our") that governs your use of our website, www.jokerbackgammon.com (the "Site"), and the services we offer through the Site (collectively, the "Services").
By accessing, browsing, or using the Site, or by purchasing products from us, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, you may not access or use the Site.
1. Use of the Site
Eligibility: Age Requirements. Neither our Site nor the use and/or purchase of our Services are intended for children. If you are under 18, you may use our Site and use/purchase our Services only with the involvement and permission of your parent or guardian. By using our Site, you represent and warrant that you meet this requirement.
License to Use: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Site for your personal, non-commercial use, strictly in accordance with these Terms.
Restrictions on Use: You agree that you will not:

To access certain features of the Site, you may be required to create an account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.
3. Purchases
Product Availability and Descriptions: All of our backgammon boards and accessories are subject to availability, and we cannot guarantee that an item will be in stock. We strive to be as accurate as possible in our product descriptions and images. However, we do not warrant that product descriptions, colors, or other content is accurate, complete, reliable, current, or error-free.
Pricing: Prices for our products are subject to change without notice. All prices are listed in U.S. Dollars. We are not responsible for typographical errors regarding price or any other matter.
Orders and Acceptance: Your placement of an order does not necessarily mean that we will accept your order. We reserve the right to refuse or cancel any order for any reason, including but not limited to product availability, errors in the description or price of the product, or error in your order. An order is not considered accepted until it has been shipped. We will attempt to notify you if your order is canceled or if additional information is required to accept your order.
Payment: We use third-party payment processors (e.g., Stripe, PayPal) to handle payment transactions. You agree to provide current, complete, and accurate payment and account information for all purchases. By submitting your payment information, you authorize us and our third-party payment processors to charge the full amount to your selected payment method.
Shipping and Risk of Loss: All purchases are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery of the items to the carrier. Shipping and delivery dates are estimates only and cannot be guaranteed.
Sales Tax: We will collect applicable sales tax on products shipped to jurisdictions for which we determine we have a duty to collect sales tax.
Promotional Codes: Promotional codes are limited in nature and may expire or be discontinued with or without notice. They are void where prohibited by law and may not be copied, sold, or otherwise offered. They are not redeemable for cash and are subject to cancellation or change at any time for any reason.

5. International Orders, Customs, and Duties
We ship our products worldwide. If you are ordering from outside the United States, you are the importer of record and are responsible for:
Ensuring the product can be lawfully imported to the destination country.
Paying all import duties, customs fees, taxes, and brokerage fees associated with the shipment. These fees are not included in the product price or shipping cost and are your sole responsibility.
We will not falsify customs declarations or mark an item as a "gift" to avoid customs fees. If you refuse a shipment due to customs-related fees, you will be responsible for the original shipping charges and any costs incurred in returning the package to us.
6. Intellectual Property Rights
All content included on the Site, such as text, graphics, logos, images, as well as the compilation thereof, and any software used on the Site, is the property of Joker Backgammon or its suppliers and protected by copyright, trademark, and other laws. The JOKER BACKGAMMON name, logo, and all related names, logos, product and service names, designs, and slogans are trademarks of Joker Backgammon. You must not use such marks without our prior written permission.
7. User Content
If you post a review, comment, or other content on the Site ("User Content"), you grant Joker Backgammon a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media. You represent and warrant that you own or otherwise control all of the rights to the User Content that you post.
8. Disclaimer of Warranties; Limitation of Liability
THE SITE AND ALL INFORMATION, CONTENT, MATERIALS, PRODUCTS, AND SERVICES INCLUDED ON OR OTHERWISE MADE AVAILABLE TO YOU THROUGH THE SITE ARE PROVIDED BY JOKER BACKGAMMON ON AN "AS IS" AND "AS AVAILABLE" BASIS, UNLESS OTHERWISE SPECIFIED IN WRITING.
TO THE FULLEST EXTENT PERMISSIBLE BY LAW, JOKER BACKGAMMON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE.
JOKER BACKGAMMON WILL NOT BE LIABLE FOR ANY DAMAGES OF ANY KIND ARISING FROM THE USE OF THE SITE OR FROM ANY INFORMATION, CONTENT, MATERIALS, PRODUCTS, OR SERVICES, INCLUDING, BUT NOT LIMITED TO DIRECT, INDIRECT, INCIDENTAL, PUNITIVE, AND CONSEQUENTIAL DAMAGES, UNLESS OTHERWISE SPECIFIED IN WRITING.
YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY DISSATISFACTION WITH THE SITE IS TO STOP USING THE SITE. IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION EXCEED THE AMOUNT YOU PAID TO JOKER BACKGAMMON FOR THE APPLICABLE PRODUCT.
9. Indemnification
You agree to indemnify, defend, and hold harmless Joker Backgammon, its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) that such parties may incur as a result of or arising from your violation of these Terms.
10. Governing Law, Dispute Resolution, and Arbitration
Governing Law: These Terms shall be governed by and construed in accordance with the laws of the State of Minnesota, without giving effect to any principles of conflicts of law.
Binding Arbitration: YOU AND JOKER BACKGAMMON AGREE TO GIVE UP ANY RIGHTS TO LITIGATE CLAIMS IN A COURT OR BEFORE A JURY, OR TO PARTICIPATE IN A CLASS ACTION OR REPRESENTATIVE ACTION WITH RESPECT TO A CLAIM. OTHER RIGHTS THAT YOU WOULD HAVE IF YOU WENT TO COURT MAY ALSO BE UNAVAILABLE OR MAY BE LIMITED IN ARBITRATION.
Any claim, dispute or controversy arising out of or relating to these Terms or the purchase of any products from Joker Backgammon will be resolved exclusively and finally by binding arbitration administered by the American Arbitration Association (AAA). The arbitration will be conducted in Hennepin County, Minnesota.
Class Action Waiver: You and Joker Backgammon agree that each may bring claims against the other only in your or its individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
11. Miscellaneous
Entire Agreement: These Terms and any policies or operating rules posted by us on this Site constitute the entire agreement and understanding between you and us.
Severability: If any provision of these Terms is determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms.
Changes to Terms: We reserve the right, at our sole discretion, to update, change, or replace any part of these Terms by posting updates on our Site. It is your responsibility to check this page periodically for changes.
